Terms and Conditions for BrandAgent Extension
- Acceptance of Terms
By using the BrandAgent extension (the “Extension”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Extension. - Description of Service
The BrandAgent extension is designed to help users check web pages against predefined brand guidelines. The Extension extracts text from web pages, sends it to an AI service for analysis, and provides feedback based on the brand guidelines. - User Responsibilities
Accuracy of Information: You are responsible for ensuring that the brand guidelines and other information provided to the Extension are accurate and up-to-date.
Compliance with Laws: You agree to use the Extension in compliance with all applicable laws and regulations in your jurisdiction. - Data Collection and Usage
Website Content: The Extension collects visible text, images, sounds, videos, or hyperlinks from the web pages you analyze. This data is used solely for analyzing the content against your brand guidelines.
User Settings and Preferences: The Extension allows you to store your brand guidelines and API keys for AI services. This data is stored locally on your device and is not transmitted to any external servers.
Data Security: We take the security of your data seriously. The data collected by the Extension is stored locally on your device and is not transmitted to any external servers. However, when you send data to an AI service for analysis, the data is transmitted over a secure HTTPS connection. - Third-Party Services
The BrandAgent extension may use third-party AI services to analyze web content. When you use these services, you agree to their respective privacy policies and terms of service. We do not have control over or access to the data collected by these third-party services. - Intellectual Property
Ownership: The Extension and all associated intellectual property rights are owned by BrandAgent and its licensors.
License: You are granted a non-exclusive, non-transferable license to use the Extension for personal, non-commercial use. - Limitation of Liability
No Warranties: The Extension is provided “as is” without any warranties, either express or implied.
Limitation of Liability: In no event shall BrandAgent be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Extension; (ii) any conduct or content of any third party on the Extension; (iii) any content obtained from the Extension; and (iv) unauthorized access, use, or alteration of your transmissions or content. - Indemnification
You agree to indemnify and hold harmless BrandAgent and its affiliates, officers, agents, and employees from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (i) your access to or use of the Extension; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. - Termination
These Terms will remain in full force and effect while you use the Extension. You may terminate your use of the Extension at any time without notice to BrandAgent. - Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. - Dispute Resolution
Any dispute arising out of or relating to these Terms or the Extension shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall be conducted in London, which is convenient for the parties. - Data Protection
GDPR Compliance: If you are an individual in the European Union, your personal data will be processed in accordance with the General Data Protection Regulation (GDPR). For more information, please see our Privacy Policy.
Data Retention: The data collected by the Extension is retained only for as long as necessary to provide the service. Once the data is no longer needed, it is deleted from your device. - Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and BrandAgent and govern your use of the Extension, superseding any prior agreements between you and BrandAgent (including, but not limited to, any prior versions of the Terms).
Amendment: BrandAgent may amend these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Extension. Your continued use of the Extension after any such changes constitutes your acceptance of the new Terms.
No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and BrandAgent’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
